Government agencies and courts have been busy. Federal and state agencies have issued new employment rulings and laws effective 2016-2017. CMS has issued a Final Rule of Participation for Nursing Home beginning November 28, 2016

CMS Final Nursing Home Rule Bans Pre-Dispute Arbitration Agreements
Binding pre-dispute arbitration agreements have been prohibited under the Centers for Medicare & Medicaid Services' final rule for long-term care facilities effective November 28, 2016. The rule makes important changes to strengthen the rights of residents and families in the event that a dispute arises with a facility. These clauses require the resident to settle any dispute that may arise using arbitration rather than the court system.
