Summer Income Tax Update

This focus will be a review of the recent finalization by the IRS of the regulations regarding the QBI deduction which will include but not be limited to:

  • What constitutes qualified business income (QBI)
  • How to calculate the QBI deduction
  • How to apply the taxable income limit and the W-2 wage and capital limit
  • Understanding when trades or businesses can be aggregated
  • Understanding how QBI losses are applied and carried over
  • How to Calculate the real estate investment trust and publicly traded partnership component of the QBI deduction
  • How to allocate QBI items to owners of a pass-through entity
  • Understanding how the understatement penalty applies to the QBI deduction
  • How to determine whether a real estate rental activity is eligible for the QBI deduction
  • How to determine whether a trade or business is a specified service trade or business (SSTB)
  • How to understand how QBI items may be limited for an SSTB
  • How to calculate the QBI deduction for an SSTB owner with taxable income in the phase-in
  • How to apply the de minimis rule to determine if a business is an SSTB
  • How to apply the anti-abuse rule to determine what part of a business is an SSTB
  • Employee and former employee issues
  • The controversy concerning the 2% shareholder's health insurance and how it impacts the QBI deduction
