The “Changes” clause is a topic of frequent discussion among people involved in Government contracts, and one of its most unique features is the language which permits a contracting officer to make an “equitable adjustment in the contract price, the delivery schedule, or both” if the circumstances justify doing so. In the September program, Professor Nash and Tim Sullivan explored the key differences between claims and requests for equitable adjustments. In our October program, Professor Nash and Tim will discuss the fundamentals of preparing a request for an equitable adjustment. They will discuss the pricing of added as well as deleted work, the burden of proof for each, the importance of understanding schedule issues, and the role of profit and interest in such calculations. You won’t want to miss this practical but critically important discussion, a discussion that is important no matter what your role in the process is.
