China and the United States are parties to the most important bilateral relationship in the world today, that between the largest advanced economy on earth and the largest and fastest-growing developing one. That’s true in the legal sphere as well. For decades, the U.S. legal profession has taken a leading role in guiding the opening of the Chinese economy and has helped along the development of a now-vibrant Chinese legal profession. In that time, thousands of Chinese students have studied law in the United States, and many of them are now senior people in government or business in China. But, in ways that mirror the larger relationship between the two countries, the largely benign image of U.S. law in China is starting to fray. Larger Chinese companies are now finding themselves beset by U.S. regulatory investigations or litigation. Accusations of political motives in the applications of U.S. laws like the FCPA or in review of Chinese merger bids in the U.S. have been met in China with the enactment of mirror-image laws and the unpredictable application of other regulations. Are different approaches to the law going to be another stressor on the U.S. - China relationship? Or will common understandings of law ultimately help the U.S. and China smooth out their differences when it comes to business and beyond?
