Counsel for the appellant gives an account of the recent Supreme Court appeal of Cedar Capital Partners LLC v FHR European Ventures & Others concerning the availability of proprietary remedies for bribes and secret commissions received in breach of fiduciary duty.
Duncan McCombe Duncan became a tenant at Maitland Chambers in 2013 following the successful completion of pupillage. Since starting tenancy Duncan has appeared regularly in his own right in the County Courts and also in the High Court. In addition, he has been led on a number of larger matters, particularly in the Company Law and Commercial Law fields. Such matters have involved applications for urgent injunctive relief and complex jurisdictional and arbitration issues. Duncan has also completed a six week secondment with a law firm in Jersey working on a large and high-profile trust dispute. He is currently instructed on the Supreme Court appeal of FHR v Mankarious & Ors and on a large-scale shareholder dispute with proceedings in the BVI and an arbitration in London.
