Peter Steen examines the development of the principles in relation to Quistclose trusts since Barclays Bank v Quistclose Investments Ltd AC 567. He outlines the commercial context to Quistclose Trusts, which have been described by Lord Millett as ‘an entirely orthodox example of the kind of default trust known as a resulting trust‘.
STEP will be tackling more Contentious Trusts issues during our 2015 Special Interest Spotlight sessions on 10 December.
