Nine justices of the Supreme Court sat to reconsider the law of illegality. Their decision, given on 20 July 2016, departs from Tinsley v Milligan. By a majority the court has adopted a quite different test for determining whether illegality is a bar to relief and it will be of great importance for trusts.
Philip Shepherd QC appeared for the respondent Mr Patel in the case assisted by Professor Graham Virgo – who has written widely on restitution and illegality.
