This workshop will meet two consecutive days from 9 AM - 4 PM.
Attendance restricted to Law Enforcement and Prosecutors only.
This course is designed to show officers and prosecutors how to draft affidavits and search warrants that will meet any attack from the defense in a Motion to Suppress. The instructors walk the students through the entire process of gathering sufficient probable cause, articulating that probable cause in a search warrant affidavit, and insuring that the search warrant authorizes the officer to search and seize all contraband and evidence relevant to the investigation. Common and not-so-common mistakes are discussed, and the students are given various affidavits and search warrants for their review to see if they can spot mistakes and potential challenges. Solutions are then provided which show how to properly write the affidavit and search warrant in the various scenarios. Each student will receive a 40+ page paper titled “How to Write a Search Warrant” that covers all the essentials to drafting a legally sound affidavit and search warrant. Ultimately, prosecutors and law enforcement will gain confidence and expertise in writing search warrants and defending their affidavits in court. The instructors will task participants with writing a search warrant before the conclusion of day 1. Participants will then receive feedback on their search warrant the following day. Due to the interactive nature of this training, class size will be limited.
