Cancellation Policy

CANCELLATION / NO SHOW POLICY In the event that the individual or entire group does not materialize / arrive, company / tour operator shall be held responsible for the payment computed as the equivalent for the full length of stay.  After the date this agreement is signed but more than ninety (90) days prior to arrival date the Hotel will hold the first deposit paid.  More than sixty (60) days but less than ninety (90) days prior to arrival date 25% of the total anticipated food & beverage and room rental revenue will be charged.  More than thirty (30) days but less than sixty (60) days prior to arrival date 50% of the total anticipated food & beverage and room rental revenue will be charged.  Less than thirty (30) days prior to arrival date 90% of the total anticipated food & beverage and room rental revenue will be charged.  Less than ten (10) days prior to arrival date 100% of the total anticipated food & beverage and room rental revenue will be charged.

Additional Information

CHANGE OF OWNERSHIP OR MANAGEMENT The Hotel must be notified in writing at least thirty (30) days prior to the effective date of any change to ownership or management. In the event of failure of such notification the terms and conditions of this agreement shall extend to successors in title along with the current owner at the time of the contract. DISPUTES, ACTION OR OTHER MATTERS ARISING It is expressly agreed and declared that the proper law of this agreement is the law of Malaysia in accordance with the laws and procedures of Malaysia and under any all circumstances. BANKRUPCY CLAUSE In the event of non-settlement of payment or loss of accreditation, the hotel reserves the right to charge and collect upfront payment from the guest upon check-in for room reservation and / or meals arrangement or other miscellaneous charges incurred by the guest. FORCE MAJEURE The obligations set forth herein shall not apply, or shall be suspended, if their performance becomes impossible as a result of an event of force majeure such as, in particular: actions by the public authorities, hostilities, war, arbitrary act by government or other authority (fait du Prince), act of God, fire, flood, strikes without notice, the Parties shall make every effort to anticipate or limit the impact of non-performance of the contract owing to an event of force majeure; the Party wishing to invoke an event of force majeure shall immediately advise the other Party of both the start and end of such an event, otherwise it shall not be exempt from liability. LOSS AND DAMAGE TO THE HOTEL PROPERTY You are responsible for all loss or damage to the property of the Hotel (including the Hotel Premises and any fixtures, furnishings or goods on or off the Hotel) caused by or arising from any act or omission by you, your guests or any other persons attending the function or present in the hotel rooms.
