Cancellation Policy

ROOMS & CATERING CANCELLATION The client acknowledges that if it cancels or otherwise essentially abandons its planned use of the contracted commitment (a “Cancellation”), this action would constitute a breach of The client’s obligation to the hotel and the hotel would be harmed. Because the hotel’s harm (and The client’s obligation to compensate the hotel for that harm) is likely to increase if there is a delay in notifying the hotel of any cancellation, the client agrees to notify the hotel, in writing, within five (5) business days of any decision to cancel. In addition, if a Cancellation occurs, the parties agree that: i. It would be difficult to determine Hotel’s actual harm. ii. Due to the short period of time between the execution of this Agreement and the Event dates, and / or the projected non-capacity occupancy of the Hotel over the Event dates, Hotel is unlikely to be able to resell rooms on a “last-sale” basis in the event of a Cancellation. iii. The amount set forth below reasonably estimates Hotel’s harm for a Cancellation. The client therefore agrees to pay the hotel, within twenty one (21) days after any cancellation, as liquidated damages and not as a penalty, plus applicable taxes, plus 100% of any amount by which any Banquet Event Order exceeds the total amount of the client’s food & beverage obligation under this Agreement. Provided that the client timely notifies the hotel of the cancellation and timely pays the above liquidated damages, hotel agrees not to seek additional damages from the client relating to the cancellation: Rooms cancellation i. From the moment of signing up to 91 days prior to the first day of the event 10% of their contracted Room Night Commitment. (non-refundable) ii. From 90 days to 31 days prior to the first day of arrival The client agrees to pay 70% of the contracted Room Night Commitment at the agreed upon group rate. iii. From 30 days to 15 days prior to the first day of arrival The client agrees to pay 80% of the contracted Room Night Commitment at the agreed upon group rate. iv. From 14 days to day of arrival The client agrees to pay 100% of the contracted Room Night Commitment at the agreed upon group rate.
