An easement is an estate in land that grants a benefit to a person or another estate in land. Because an easement is a limited transfer of property rights, questions frequently arise about what is allowed under an easement and what compensation is due to the fee simple landowner. This article draws on example conflicts faced by landowners across Indiana while striving to answer two fundamental questions: Is landowner permission required, and must the landowner be compensated?
