2019 Simcenter Conference Registration Terms & Conditions

By registering for a Siemens Digital Industries Software 2019 Simcenter Conference (the “Conference”), the registering entity (“You,” “Your” or the “Participant”) agree to be bound by these Siemens Simcenter Conference Registration Terms & Conditions (“Terms”). These Terms will apply to Participant’s employees, agents, consultants, directors, or any other persons attending the Conference and the Participant will be responsible for their compliance with these Terms.  The Conference is presented and organized by Siemens Digital Industries Software.

Registration Fee
The registration fee is listed on the Conference website and includes the activities and benefits expressly listed as part of the Conference package chosen by You. Anything not expressly listed as part of the chosen package, is not included in the registration fee and is the exclusive responsibility of the Participant, including but not limited to, travel costs and expenses and any accommodations not booked through Siemens Digital Industries Software. Prices are always presented as VAT/Tax exclusive, You are responsible for any applicable VAT or other taxes.

Payments
Participant need to pay for registration online by credit card.

Confirmation of Registration
A legally binding contract will be formed when You receive confirmation that Your registration has been processed and Siemens Digital Industries Software has received payment by credit card or a valid purchase order (whichever is applicable). Siemens Digital Industries Software
will not be responsible if You fail to receive confirmation because You have supplied us with an incorrect e-mail or postal address. If You do not obtain a confirmation, please send an e-mail to 
marianne.mueller@siemens.com.

Cancellations
Siemens Digital Industries Software reserves the right to defer or cancel the Conference if there are insufficient bookings or conditions arising beyond our control. Siemens Digital Industries Software will reschedule the Conference to an alternative date and/or provide You with a full refund.
Cancellations by the Participant must be received in writing by email to marianne.mueller@siemens.com. 

Refunds

Cancellation by the registrant will be subject to cancellation charges as follows:

  • Upon cancellation by email at least 60 days before the Conference, Siemens Industry Software will refund Your entire Conference registration fee.
  • Upon cancellation by email at least 30 days before the Conference, Siemens Industry Software will refund 50% of Your Conference registration fee.

For cancellations less than 30 days before the Conference, no registration fee will be refunded.

Changes
Siemens Digital Industries Software reserves the right to make changes to the published program of the Conference (e.g. to timings or speakers if one or more of the advertised speakers is unable to attend, timing or content of activities, etc.).       

Privacy
Siemens Digital Industries Software may use, reproduce and/or transcribe the audio and/or video recording taken of the activities and events of the Conference, in whole or in part, in any form of media, (“Recordings”) for use in its marketing materials. Siemens Industry Software is hereby granted permission to use Participant’s likeness (e.g., name, likeness, image, voice, quotes, biographical information, or any photograph, portrait, film, video, DVD, CD, digital image, audio recording, or other recording taken of you) in its Recordings (“Rights”).   Rights are granted to Siemens Digital Industries Software on a non-exclusive, royalty-free, worldwide, transferable basis, to be used in any way deemed appropriate for its business. Participant will retain ownership of the intellectual property in its likenesses. Participant will not receive any rights or ownership to Siemens’ Recordings incorporating, in whole or in part, the Rights. Siemens reserves exclusive control over the content, formatting, presentation, and style of its Recordings. You hereby waive any and all moral rights, rights of publicity, privacy rights, and rights to sue Siemens Digital Industries Software for any violation of such rights, slander, libel, or other similar rights as a result of using the Rights.  

Rights in Material
All copyright and other rights in materials provided to You during or for the purposes of the Conference are the property of Siemens Digital Industries Software or its licensors. You are entitled to use such materials only for Your own personal use. You are not entitled to copy such materials (except as permitted by law) nor are You entitled to use or authorize others to use them for any commercial purposes.

Liability and Insurance
Siemens Digital Industries Software will not assume any responsibility whatsoever for any damage or injury to persons or property during the Conference. We recommend that the participants arrange their personal travel and health insurance.  Siemens Digital Industries Software
shall have no liability for loss or damage to any of Your personal property except where this is due to the gross negligence of Siemens Digital Industries SoftwareSiemens Digital Industries Software will not be liable for any indirect or consequential loss or any loss of profits or loss of business (direct or indirect) suffered by you. Siemens Digital Industries Software
’ total liability in contract, tort (including but not limited to negligence), or otherwise shall not exceed the relevant registration fee paid.  Participant agrees to protect and hold harmless Siemens Digital Industries Software
and venue facility from any and all claims for damages, injuries, etc., which may arise from Your participation or attendance of the Conference, and is not a result of Siemens’ negligence or intentional misconduct. Siemens Digital Industries Software, the venue facility will not be responsible in any way for the safety of a Participant, his officers, agents, or employees, nor for the safety of any Participant from theft, fire, accident, or any other destructive cause.

Applicable Laws and Competence
The relationship between Siemens Digital Industries Software and the Participant will be exclusively governed and construed in accordance with the laws of New York without giving effect to any principles of conflicts of law. If no agreement can be reached, any dispute related to the commercial relation will be brought exclusively in the state or federal courts of the state of Delaware, USA. 

Force Majeure

Siemens Digital Industries Software will not be liable for any default or delay in the performance of its obligations, to the extent that such default or delay is caused, directly or indirectly, by an event beyond the reasonable control of Siemens Digital Industries Software such as, but not limited to: fire, flood, earthquake, elements of nature, acts or regulations of government bodies, court orders, acts of war, terrorism, riots, civil disorders, rebellions or revolutions, strikes, lockouts or labor difficulties. Such event or circumstance giving rise to the default or delay is a Force Majeure Event.

Entire Agreement

These Terms apply to online registrations to Siemens Digital Industries Software Simcenter Conference. We recommend you to read these Registration Terms and Conditions on the Siemens website before submitting each booking, or write to Siemens Digital Industries Software
to request a copy of the same. These Terms are the entire agreement between the Participant and Siemens Digital Industries Software
with respect to the subject matter hereof.  Any changes to the Terms must be made in writing signed by authorized representatives of Participant and Siemens Digital Industries Software.
