The United States Court of Appeals for the District of Columbia on February 1 granted EPA’s motion to delay (“stay”) air emission reporting requirements for livestock operations until May 1, 2018. We hope that this will give the agency, and perhaps Congress, time to help provide additional clarity to the situation.
EPA reports: Farms with continuous releases of manure-based ammonia and/or hydrogen sulfide emissions do not have to make their initial continuous release notification until the DC Circuit Court of Appeals issues its order, or mandate, enforcing the Court’s opinion of April 11, 2017. The court is expected to issue the mandate on May 1, 2018. No reporting is necessary until the mandate is issued.
