IALF Supports Family Farm in Fight Against Lawsuit

The IALF has pledged $10,000 to assist in the defense of a turkey farm insouthern Indiana. The family that owns the farm was sued by several individualswho live one-half mile or more away from the facility. The claim, which wasfiled before the construction of the two poultry buildings which will houseapproximately 18,000 birds, essentially states that no matter how well the farmis operated, its presence is a nuisance.

The support of the case marks the continued effort of the IALF to engage inprecedent- setting lawsuits. Very few cases have resulted in the finding of ananticipatory nuisance. It is the hope of the IALF and the family that has beensued that they will soon prevail and ensure that anticipatory nuisance lawsuitsdo not become a tool used to stop construction and expansion of farms.
