Indiana Ag Law Foundation Hires Director

John Shoup has recently been named the in-house director of the Indiana Agricultural Law Foundation.

In 2005, Indiana Farm Bureau established the IALF as a charitable organization promoting a better understanding to the agricultural community of legal issues that directly affect them. Although a separate entity, Indiana Farm Bureau has been supportive of the IALF since its creation.

Court Rules in Favor of EPA on Chesapeake Bay TMDL

A federal district court has ruled that the EPA can mandate how states set local limits on pollution. The case was the first to question the power of the EPA to direct how states regulate pollution for nonpoint sources. The decision calls into question the general belief that Congress gave states the primary authority to determine how pollution abatement measures should be allocated under the Clean Water Act.

NIPSCO Transmission Line Meetings

The IALF joined with Indiana Farm Bureau to host two meetings for landowners and tenants who will be affected by the NIPSCO high-voltage transmission line that will be constructed from Reynolds (White County) to Topeka (LaGrange County). Seventy-five people attended a meeting in Warsaw; 29 people attended the meeting in Francesville. Farm Bureau’s Justin Schneider provided an overview of the project. Outside counsel discussed the rights of landowners and identified key issues for negotiating an easement with NIPSCO.


Natural Resource Enterprises Programs

IALF recently hosted workshops designed for landowners interested in developing businesses that take advantage of the natural resources on their property. One workshop was held on Sept. 4 in Versailles on the property of Bob and Ellen Mulford, and a second workshop was held on Sept. 5 in Crawfordsville on the property of Rick and Debbie Schavietello. The program gives participants the chance to learn about starting their own value-added business or to improve on existing ventures. The Versailles workshop had 33 attendees and the Crawfordsville program had 21.

The NRE program educates non-industrial private landowners about sustainable natural resource enterprises and compatible habitat management practices. In Indiana it is coordinated by Purdue University, IALF and Indiana Farm Bureau in partnership with Mississippi State University.

Over the next year, we will explore the various aspects of agricultural leases.  Our November issue will focus on the timing of terminating a farmland lease.
