Federal Judge Permanently Blocks Parts of Indiana's Immigration Law

In July 2011, Indiana Senate Enrolled Act 590 became law. This controversial law was designed to reform and revamp immigration enforcement in Indiana. A group of individuals who stood to be negatively impacted by two specific provisions of SEA 590 filed a class action lawsuit in federal court to halt enforcement of the law. In this lawsuit, plaintiffs challenged Sections 18 and 20 of the act. Section 18 sought to prohibit the use and acceptance of consular identification cards as official forms of identification.

SE 207 Heads to Governor for Signature: Certain Undocumented Youth May be Eligible for Indiana Resident Tuition Rate

Following passage by the Indiana Legislature, House Enrolled Act 1402 went into effect on July 1, 2011. The law restricted public universities from allowing students who are not lawfully present in the U.S. to pay in-state tuition. With this change in the law, hundreds of Indiana students found themselves in a tough situation with their educational costs nearly tripling at some state schools. Senate Enrolled Act 207 represents a shift in the law in favor of these students. Now on its way to the governor for signature, SEA 207 will grandfather or allow those undocumented students who were enrolled in an Indiana state university before July 1, 2011, to again qualify for resident tuition.

National Litigation Update

Several national cases which have the potential to impact Indiana farmers have been the subject of much discussion in recent weeks. While the IALF is not involved in any of these lawsuits, we thought you still might want to know about them.

In Alt v. EPA, West Virginia farmer Lois Alt challenged the ability of EPA to force her to acquire a National Pollutant Discharge Elimination System (NPDES) permit for her poultry farm.
