Supreme Court to Review Rockport Gasification Contract

The Indiana Supreme Court granted transfer in Indiana Gas Company v. Indiana Regulatory Commission, a court of appeals case involving the Rockport gasification plant.  A divided Indiana Court of Appeals reversed an Indiana Utility Regulatory Commission order that approved a contract that would have funded the Rockport plant. The majority of the court found that the entire contract must be voided because the definition of “retail end use customer” in the contract varies from the statutory definition.  However, one judge dissented and found that only the portion of the contract with the language “retail end use customer” must be voided.  The Indiana General Assembly left the matter up to the courts in Senate Enrolled Act 494.  If the Indiana Supreme Court justices reverse the Indiana Court of Appeals and find that the entire contract is not voided, there will still be a new round of state regulatory review because of SEA 494.
