Cancellation Policy
Acceptance of the present agreement ensures that Delano Dubai will reserve the contractual arrangements and services for the sole use of the Patron. Any changes made to the agreement must be arranged within the following time frame: • If the Patron cancels more than 10% of the initially reserved Conference and Banqueting facility, Delano Dubai will charge the Patron the amount, which will be calculated according to the below mentioned scheme based on the projected revenue that could have been generated by the cancelled bookings. Calculation is made, considering the time interval before the arrival date. • If the Patron cancels the entire booking after confirmation, Delano Dubai shall have suffered damages equivalent to the profits that Delano Dubai would have earned from the sale of any of the booked arrangements and services in connection with the booking. The parties acknowledge that it is difficult to quantify such damages and have agreed that Delano Dubai shall assess a cancellation fee. (the “Cancellation Fee”) against the Patron as liquidated damages and not as a penalty. The parties agree that Cancellation Fee will be based on the date written notice of cancellation is received by Delano Dubai and calculated as a percentage of anticipated revenue in accordance with following scale: TIME INTERVAL BEFORE ARRIVAL DATE PERCENTAGE FROM PROJECTED REVENUE More than 60 days Non-refundable first deposit (25%) From 30 to 60 days 75% Less than 30 days 100% • Notice of any cancellations must be received by Delano Dubai in writing. In the case of cancellation, the cancellation fee is payable within fourteen (14) business days of being invoiced by Delano Dubai after which time the cancellation fee will bear interest at the rate of 4% per month until paid, unless this rate exceeds the maximum rate permitted by applicable laws, in which event the maximum legal rate shall apply. Deposit paid by Patron will be applied against the cancellation fee owing. • In case of No-Show, 100% of the total contracted charges of your booking in this agreement, will be applied.
