"No show" / withdrawal / cancellation by Customer 1. Withdrawal by the Customer from the contract concluded with the Hotel shall, subject to the provisions of clause VI. no. 4., require the consent of the Hotel in text form (section 126b BGB). 2. The agreed fee for rented hotel rooms must, subject to the provisions of clause VI. no. 4., be paid even if the consent required under subclause 1. has not been given or if the booking is cancelled by the Customer or if the Customer does not show up. The Hotel must accept the crediting to the Customer of the value of the expense it saves and of the benefits which accrue to it (the Hotel) through letting to other customers. In the event of withdrawal the Customer shall as a fundamental rule, subject to the provisions of clause VI. no. 4., be obliged to pay 90% of the contractually agreed price for accommodation with or without breakfast, 70% for half board and 60% for full board arrangements. The Customer shall however be permitted to provide evidence that the Hotel has incurred no loss whatsoever or much less loss. 3. The agreed fee for rented Premises must, subject to the provisions of clause VI. no. 4., be paid even if the written consent required under subclause 1. has not been given or if the booking is cancelled by the Customer or if the Customer does not show up. In the case of unwarranted withdrawal from the contract by the Customer (cancellation) the Hotel shall be entitled, having credited the Customer for any expense it may have saved, to require 90% of the total order amount (including the revenue from the food sales not made) and, in the case of cancellation up to 4 working days before the start of the event and, in the case of later cancellation, to require 100% of the total order amount (including the revenue from the food sales not made). If no price has been agreed for the food, the amount shall be based on the most inexpensive 3-course menu in the event offer valid at the time. The Customer reserves the right to provide evidence that no loss whatsoever or much less loss has been incurred and the Hotel that greater loss has been incurred. 4. The foregoing subclauses shall not apply in the event of a breach by the Hotel of the obligation to take account of the Customer's rights, legal assets and interests if the latter can no longer be reasonably expected to adhere to the contract or is entitled to other statutory or contractual rights of withdrawal.
