Cancellation Policy

(a) By Client. In the event that Client desires to terminate this Agreement for any reason, Client shall send written notice to Lafayette One26 LLC of such intent (the “Client Termination Notice”), and the following conditions shall apply: (i) In the event that the Client Termination Notice is delivered to Lafayette One26 LLC at least sixty (60) calendar days prior to the Event Date, Client shall receive a full refund of any amounts previously paid by Client to Lafayette One26 LLC hereunder (subject to any deductions in the Security Deposit as provided in Section 2), less a termination fee equal to twenty five percent (25%) of the Initial Deposit, which amount shall be retained by Lafayette One26 LLC. (ii) In the event that the Client Termination Notice is delivered to Lafayette One26 LLC at any time between fifty-nine (59) calendar days and twenty (16) business days of the Event Date, then Client shall receive no refund of the Initial Deposit, which amount may be retained by Lafayette One26 LLC, provided, however, that the Security Deposit shall be refunded in accordance with Section 2, as of the date on which the Client Termination Notice is received. (iii) In the event that the Client Termination Notice is delivered to Lafayette One26 LLC at any time within nineteen (15) business days of the Event Date, then the entire Total Contract Price shall be due and payable by Client to Lafayette One26 LLC as of the date on which the Client Termination Notice is received, and no refund whatsoever shall be made with respect to the Total Contract Price, provided that the Security Deposit shall be refunded in accordance with Section 2.
