Cancellation Policy
(a) By Client. In the event that Client desires to terminate this Agreement for any reason, Client shall send written notice to Triangle Loft/Bento of such intent (the “Client Termination Notice”), and the following conditions shall apply: (i) In the event that the Client Termination Notice is delivered to Triangle Loft/Bento at least sixty (60) calendar days prior to the Event Date, Client shall receive a full refund of any amounts previously paid by Client to Triangle Loft/Bento hereunder (subject to any deductions in the Security Deposit as provided in Section 2), less a termination fee equal to twenty five percent (25%) of the Initial Deposit, which amount shall be retained by Triangle Loft/Bento. (ii) In the event that the Client Termination Notice is delivered to Triangle Loft/Bento at any time between fifty-nine (59) and eleven (11) calendar days of the Event Date, then Client shall receive no refund of the Initial Deposit, which amount may be retained by Triangle Loft/Bento, provided, however, that the Security Deposit shall be refunded in accordance with Section 2, and Client shall receive a full fund of any amounts (if any) previously paid toward the Balance as of the date on which the Client Termination Notice is received. (iii) In the event that the Client Termination Notice is delivered to Triangle Loft/Bento at any time within ten (10) calendar days of the Event Date, then the entire Total Contract Price shall be due and payable by Client to Triangle Loft/Bento as of the date on which the Client Termination Notice is received, and no refund whatsoever shall be made with respect to the Total Contract Price, provided that the Security Deposit shall be refunded in accordance with Section 2.
