Política de cancelamento

If this Agreement is cancelled by Renter, the parties agree that the Hilton/Magnoliya will have lost the revenue represented by this Agreement, and also the opportunity to offer Renter’s unused facilities to others either individually or as part of another party and Hilton/Magnoliya will incur additional costs in attempting to resell inventory. The parties agree that since the exact amount of such damages will be difficult to determine, the liquidated damage clauses provided for in this Agreement are a reasonable effort by the parties to agree in advance on the damages that the Hilton/Magnoliya will suffer due to a cancellation. Therefore, Renter agrees that should Renter cancel the Event for any reason other than due to a valid Impossibility occurrence, including changing the meeting site to another venue, Renter will pay as liquidated damages to the Hilton/Magnoliya a percentage of the Total Anticipated Revenue for the Event, plus any applicable state and local taxes as required by law, as follows: Cancellation between date of signing and 121 days out: 25% Cancellation between 120 days and 91 days out: 50% Cancellation between 90 days and 31 days out: 75% Cancellation between 30 days and date of arrival: 100% Payment of cancellation damages is due at the same time Renter provides written notice of cancellation to the Hotel. Hilton/Magnoliya may consider notice of cancellation to be invalid and thus may not release accommodations held until pay. Hilton/Magnoliya Grand cannot guarantee date transfers are available, unless there is an Act of God.
