VAT REFUND FOR FOREIGN TOURISTS Where appropriate, the HOTEL shall reimburse to the CLIENT the Value Added Tax (VAT) applicable to the lodging and breakfast services, whenever breakfast is included in the lodging fee, under the terms, subject to the conditions and to the extent set forth in the Value Added Tax Law of the Argentine Republic, as restated in 1997 and amended, Executive Order No. 1.043, General Joint Resolution No. 3971 and Resolution 566/2016, as supplemented and amended. For clarification, and without limitation to the requirements and conditions set forth under the applicable regulations referred to above, the reimbursement of VAT shall apply if and only if each and all of the following requirements are met: 1. The guest is a foreign tourist, as defined in the applicable regulations. 2. Payment is made through an international debit or credit card issued abroad or through a transfer of foreign currency made from abroad In order to obtain any such reimbursement, the CLIENT shall provide the HOTEL with all information and documentation required under the laws and regulations in force. In case cancellation or “No Show” penalties should apply, such amounts shall not be subject to the reimbursement of VAT described in this clause, pursuant to the laws in force. Urban Use Law tax (For tourists, per night, per person) The rates corresponding to the “Urban Use Law” established under the Article 8 of Law 6278 of the Government of Buenos Aires city will be added to the previously expressed room rates. The Urban Use Law is USD 1.50 and will apply to tourists who are not Argentinean residents, from 12 years of age. The mentioned rate applies per night and per person. It will be determined by the closing USD selling rate of Banco de la Nación Argentina, on the day prior to check out date.
